On July 8, 2014, the new Regulation on Simple and Other Buildings and Works NN 79/14 came into force.
The most significant change probably relates to the possibility of building single-story auxiliary buildings up to 50m², but on the condition that they are on the same plot as the main building and serve the needs of that main building. Also, for the first time, the possibility of building rooftop houses without a construction permit is being introduced.
Still, for both, there’s an obligation to create a main project and carry out construction according to professional standards, and only if the spatial plan allows it (the built-up area of the plot and Ki, distance from boundaries, etc.). Among other updates, the garden gazebo doesn’t have a set maximum allowed area, while the carport stays the same as before. 15m², pools 100m².
There are new rules for fences, walls, and retaining walls. So for fences up to 2.2m high, boundary walls up to 1.6m, and retaining walls up to 1m, you don’t need a permit or a project. However, if the fence, boundary wall, or retaining wall exceed these heights, you only need to make a main project, but you still have to follow the parameters of the spatial plan.
